we will collect certain information about you during your visit.

If you choose to sign up for our newsletter, make a booking, or contact us, you will be requested to provide your name and email address as identifying information, as well as a contact number for the purposes of appointment management, as necessary.

This information is collected and stored, with your details added to a customer management system. When providing this information, you are consenting to the following:

  • The collection and storage of the provided information; and
  • The receipt of emails related to the product or service you opted in to receive, our regular newsletter, and/or email and phone contact if required for appointment management and/or other communications and/or promotional messages.

You have the right to withdraw this consent at any time using the 'unsubscribe' link provided or by contacting us in writing or via the contact form.

Jo Herbert-Doyle has adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act). The APPs govern the way in which an individual or company can collect, use, disclose, store, secure and dispose of your personal information. A copy of the Australian Privacy Principles may be obtained from the website of The Office of the Australian Information Commissioner at www.aoic.gov.au.

What is personal information, and why is it collected?

Personal information is information, or an opinion, that identifies an individual. Examples of personal information we collect include your name and email address. If you are working one-on-one with Jo, then your personal information will also include contact details and details about you and your health history, such as your date of birth, current or past health concerns, and treatment notes from your sessions together.

This personal information is obtained in many ways, including via interview, correspondence, telephone, email, or the websites listed above.

We collect personal data when you choose to subscribe to our newsletter, make a booking, complete a new client form for the purposes of a one-on-one session with Jo, when you make use of one of our products or services, when you interact with us via social media, or via one of our websites, by correspondence or by phone.

We collect your personal information for the primary purpose of providing our services to you, providing information to you, and for marketing and business development. We may also use your personal information for secondary purposes closely related to the primary purpose in circumstances where you would reasonably expect such use or disclosure. From time to time, we may contact you to voluntarily respond to market research to seek your opinion and feedback. The provision of such information by you is optional.

You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

Collecting personal data is based upon the consent of the subscriber. A subscriber's personal data is transferred to and processed by Mailchimp and Square. These are two of our key processors that collect and store personal data.

Personal information is collected for the purposes of:

  • Identifying and understanding your needs
  • To contact and communicate with you
  • To keep a record of our work together
  • To customise and improve our websites and ensure they function correctly
  • For market research and business development, as well as email updates.

What is sensitive information?

Sensitive information is defined in the Privacy Act. In this context, we consider your sensitive information to be your personal and health information.
Sensitive information will only be used by us:

  • For the primary purpose for which it was obtained
  • For a secondary purpose that is directly related to the primary purpose
  • With your consent, or where required or authorised by law.

Where reasonable and practicable to do so, we will collect your personal information only from you. However, in some circumstances, we may be provided with information by third parties (for example, in-person bookings at our practice location). In such a case, we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.

How long is my personal information retained?

Health records must be retained for a minimum of seven (7) years for adults. Otherwise, we store personal information only for as long as it is deemed necessary to fulfil its purpose. When the personal information collected is no longer required, it is deleted securely.

Disclosure of personal information

Your personal information may be disclosed in several circumstances, including the following:

  • To provide services to clients and customers
  • To credit reporting agencies and courts, tribunals, and regulatory authorities where customers have failed to pay for goods or services provided to them
  • Where required or authorised by law
  • To third-party service providers who assist in providing information, products, or services to you, which may include overseas parties in the United States of America

Website cookies

From time to time, we may choose to use cookies on our websites. Cookies are text files placed in your browser that store your preferences. Cookies do not provide us with an email address or other personally identifiable information; however, this information may be linked to the data stored in the cookie.

We may also use web beacons on our websites. Web beacons are small pieces of code that are placed on web pages to monitor user behaviours, and these collect data about visitors to specific web pages. IP addresses

Our websites use Internet cookies. These log information about your site visit, such as the type of browser you are using, the operating system you are using, and your computer IP address.

An IP address is used by your computer each time you connect to the Internet. It is a number used by computers on this network that identifies your computer. Our web servers automatically collect IP addresses as part of the demographic and profile data referred to as ‘traffic data’. This data is required so that other data, such as the web pages you request, can be sent to you.

Third-party links

Our websites may link to third-party websites of interest. We do not have any control over these websites and are not responsible nor liable for the protection and privacy of any information you provide when visiting third-party websites. This Privacy Policy does not govern third-party websites. We do not guarantee website links or the policies of authorised third parties.

Email policy

If you choose to correspond with us via email, we may store the content of your email message along with our response and your email address. The protection of electronic communication is the same as that employed by information received online.

We are committed to keeping your email address confidential. We do not sell, lease, or rent our subscription lists to third parties and will not provide your personal information to any third-party individual, company, or government agency at any time unless strictly compelled to do so by law.

Your email address is solely used to provide you with timely information concerning our services and/or our newsletter.

Security of personal information

We take reasonable steps to ensure that the personal information collected from you is accurate, up-to-date, complete, and stored in a manner that reasonably protects it from misuse, loss and unauthorised access, modification, or disclosure. Most of our data collection is digital; however, handwritten session notes are either stored in a secure filing system or transformed into digital format, and the original is destroyed securely.

All personal data is secured in the first instance via password protection on Jo’s computer and/or other devices and then by secondary password protection via any and all access points, including but not limited to Square, Mailchimp, and Google Suite.

No information transmitted over the Internet can be guaranteed to be secure. We cannot guarantee the security of any information transmitted to us or that you receive from us. The transmission and exchange of information is carried out at your own risk. Whilst we will take measures to safeguard your personal information against any unauthorised disclosure, we cannot assure you that the personally identifiable information collected and stored by us will never be disclosed in a manner inconsistent with this Privacy Policy.

We may use software that creates summary statistics for such purposes as assessing site visitor traffic, information of most and least interest, determining technical design specifications, and identifying problem areas and system performance. For site security purposes, we also use software programs to monitor traffic that will identify unauthorised attempts to upload or change information or otherwise cause damage.

When your personal information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your personal information. However, most of the personal information is or will be stored in client files, which will be kept by us for a minimum of seven (7) years as per Australian health information record requirements.

Your rights regarding your personal information

 

Access

You have the right to request access to the personal information we hold about you and to update or correct it, subject to certain exceptions set out in the Privacy Act 1988 (Cth). Please contact us in writing if you wish to access your personal information.

We will not charge any fee for your access request but may charge an administrative fee for the time and resources used when providing a copy of your personal information.

To protect your personal information, we may require identification from you before releasing or amending the requested information.

Accuracy and quality

It is important to us that your personal information is up to date. We will take reasonable steps to ensure that your personal information is accurate, complete, and up-to-date. If you find that the information we have is not up-to-date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

To protect your personal information, we may require identification from you before amending the requested information.

Restriction

You may choose to restrict the collection or use of your personal information. If you have previously consented to the use of your personal information for marketing purposes, you may withdraw this consent at any time by contacting us in writing. Exceptions to restricting the use of your personal information include when we are required to do so by law (for example, health records must be maintained in their complete form for the required minimum period).

This Policy may be amended from time to time at our sole discretion, with or without notice. Amendments may include changes, additions, and deletions.
